1. Definition
This website is operated by Southeast Flowers Limited (referred to as “we/our/us”). As user of this website (referred to as “you/your”) you acknowledge that any use of this website including any transactions you make (“use/using”) is subject to our terms and conditions below. Please read through these terms and conditions carefully before using this website.
2. Contract
2.1 These Terms & Conditions govern the supply of goods sold by Southeast Flowers Limited, Unit 1 & 2 Chart Enterprise Park, Dencora Way, Ashford, Kent, TN23 4FL, to the customer named on the order form provided on the South East Sundries website. Together with the completed order form, these Terms & Conditions constitute the entire and only agreement between us in relation thereto. Our acceptance of your order by delivery of goods constitutes a legally binding contract between us on these terms and conditions. These Terms and Conditions do not affect your statutory rights.
2.2 We will confirm acceptance of your order. This will occur either by message on the website immediately after you have confirmed your order, or by us sending an e-mail to the e-mail address you have provided to us. We may do both, in which case the acceptance will occur on whichever arrives sooner of the web message and the e-mail. At this point the purchase contract will be made and we will supply the goods to you in accordance with your order and these Terms and Conditions.
2.3 All products are subject to availability, if your order cannot be fulfilled you will be contacted.
3. Price and Payment
3.1 All orders must be paid for in full by Credit, Debit card or PayPal.
3.2 The price payable for the goods you order is as set out on our web site at the time you place your order. If we discover an error in the price of goods you have ordered, we will inform you as soon as possible and give you the option of reconfirming your order at the correct price or cancelling it. If we are unable to contact, you we will treat the order as cancelled. If you cancel and you have already paid for the goods, you will receive a full refund.
3.3 We must receive payment for the whole of the price of the goods you order and any applicable charges for carriage and insurance before your order can be despatched unless we have agreed otherwise in advance in writing.
3.4 Prices and delivery charges are subject to change without notice.
3.5 All prices are shown in pounds sterling exclusive of VAT, which will be added at the prevailing rate.
4. Delivery & Title
4.1 There is no minimum order value.
4.2 Delivery charges apply to all orders and is calculated by weight and added automatically at the checkout. Free delivery applies to orders over £150 excluding VAT delivered throughout Mainland United Kingdom except to the following destinations: Northern Ireland, Offshore & Channel Islands, Eire and the Scilly Isles where it may be necessary to make additional charges as per carrier’s rates.
4.3 If due to the weight or volume of your order being excessive, in relation to the value, there may be additional delivery charges to be added, even if your order qualifies for free delivery. These charges would be at our discretion and would be discussed with you prior to dispatch.
4.4 Wherever possible if your order is placed before 12.00 noon, we will endeavour (we will try) to have it ready for collection by our courier the next working day with delivery being made within 3 days. This is subject to the items being in stock, us being very busy and the couriers up to 3-day delivery service, over which we have no control. Please Note: During very busy periods delivery can take approximately 5 working days.
4.5 Notwithstanding delivery times quoted in 4.4 above no guarantee as to time of delivery is given or implied.
4.6 If for any reason nobody is in/or the premises are closed we will post a card through the letterbox advising you that we have attempted delivery and inviting you to telephone the carrier to arrange at convenient time the parcel can be redelivered.
4.7 As soon as the goods are delivered to you, they become your responsibility. We will deliver only to the address on the order. From the time of receipted delivery, any loss or damage to the goods will be your responsibility and at your risk. Any transit damage, shortages or wrong goods supplied, must be noted at the time of delivery.
4.8 We operate a recycle policy. Wherever possible all our packaging will be recycled.
4.9 Damaged, or faulty goods, must be reported within 48 hours of delivery date. In cases of goods received damaged or faulty please retain the product (together with any packaging) and contact us within 48 hours of receipt (commencing the day after delivery), whereupon we will arrange for the item to be exchanged or offer a full refund. This does not affect your statutory rights as a consumer.
5. Availability
We try to make sure we only show items on the site if we currently have them in stock or are expecting fresh stocks shortly. From time to time items might be shown available on the site which are not available, while we try our best to keep advertised stock available we do sometimes run out of stock before the site is updated. All orders are subject to availability.
6. Returns Policy
Damaged or faulty goods must be reported within 48 hours of delivery date. In cases of goods received damaged or faulty please retain the product (together with any packaging) and contact us within 48 hours of receipt (commencing the day after delivery), whereupon we will arrange for the item to be exchanged or offer a full refund. This does not affect your statutory rights as a consumer.
Unwanted items may be returned within seven days of receipt providing we are notified within 48 hours of receipt of goods. These goods must be in perfect resalable condition and in their original packaging. Customers must ensure the goods are securely packed and are responsible for paying the relevant return carriage costs. A deduction of 15% will be made to cover our administration costs, and the net refund will be paid through the original Credit/Debit Card system. This does not affect your statutory rights as a consumer.
7. Security and Privacy
Shopping on our site is safe. We do hold no payment details on file. Once we have processed your order, we erase your card information so that it is not available for inspection by others. We use the latest Internet standard encryption technology to scramble your sensitive data when you transmit it to us. To check that you are in a secure area of our site look at the bottom of your browser and you will see a closed padlock or an unbroken key. Please be assured that we will not take any payment until we’ve made sure that all the goods on your shopping list have been processed.
8. Privacy Policy
We utilise the latest in Secure Server Technology to ensure that all personal and transactional information is protected to the highest standards. All information collected on our order form for internal use only, including customer and recipient personal details. This information is necessary to ensure the smooth processing of your order and allows us to contact you if any problems occur. We never make your personal details available to companies outside the company for any purposes. All information is collected lawfully and in accordance with the Data Protection Act 1998. 9. Liability
9.1 We will use reasonable endeavours to verify the accuracy of any information on the site but makes no representation or warranty of any kind express or implied statutory or otherwise regarding the contents or availability of the site or that it will be timely or error-free, that defects will be corrected, or that the site or the server that makes it available are free of viruses or bugs or represents the full functionality, accuracy, reliability of the website We will not be responsible or liable to you for any loss of content or material uploaded or transmitted through the website and We accept no liability of any kind for any loss or damage from action taken or taken in reliance on material or information contained on the site.
9.2 We will take all reasonable precautions to keep the details of your order and payment secure, but, unless we are negligent, we cannot be held liable for any losses caused as a result of unauthorised access to information provided by you.
10. General
10.1 We reserve the right to change these terms and conditions at any time. Any such changes will take effect when posted on the website (see date at the top) and it is your responsibility to read the terms and conditions on each occasion you use this website and your continued use of the website shall signify your acceptance to be bound by the latest terms and conditions.
10.2 If any of these Terms and Conditions is held by any court of competent authority to be unlawful, invalid or unenforceable, in whole or in part, this will not affect the validity of the remaining Terms and Conditions which will continue to be valid and enforceable to the fullest extent permitted by law.
10.3 All copyright, trademarks and all other intellectual property rights in all material or content supplied as part of this website shall remain at all times vested in us or our licensors. You are permitted to use this material only for your personal use in placing orders through southeastsundries.co.uk and you may not copy, reproduce, transmit, publish, display, distribute, commercially exploit or create derivative works of such material and content.
10.4 These Terms and Conditions will be governed by English law and the parties submit to the exclusive jurisdiction of the English courts in relation to any dispute which may arise between them.
11. Order Cancelation
11.1 If you wish to cancel your order, please contact us on 01233 625678 as soon as possible. If the order has been picked and packed, a 15% charge will be levied for the order. A new order will not be taken from any customer that has cancelled an order and not paid the cancelation charge.
